Impaired Driving
An impaired driving charge is laid when the police believe that you have operated a vehicle while under the influence of drugs or alcohol to such a degree that it affected your ability to drive safely.
Domestic Violence
Domestic violence entails criminal charges that involve either a family member or a current/former romantic partner. Criminal charges that arise out of a domestic situation are taken more seriously by the Crown and the Court than the same criminal charges in non-domestic contexts.
Assaulting a Peace Officer
Assaulting a peace officer is classified under “Offences Against the Person and Reputation” in the Criminal Code of Canada (the “Code”). This offence has the same elements and maximum punishments as a conviction for common assault, but it specifies that the victim is a peace officer.
Drug Offence
Drug charges are those offences which arise from an interaction with an illicit drug or substance. Drug offences are listed under federal legislation called the Controlled Drugs and Substances Act (“CDSA”), not under the Canadian Criminal Code.
Youth Offences
If you have commit a crime and are between the ages of 12 and 17, the prosecution of your offence will be conducted under the Youth Criminal Justice Act (YCJA). Even though a different act governs the prosecution of youths, all of the crimes specified by the Criminal Code of Canada are applicable to young offenders.
Criminal Driving
Criminal driving encompasses multiple motor vehicle offences in the Criminal Code, and is different from charges under the Traffic Safety Act of Saskatchewan (e.g. impaired driving vs careless driving).
Assault
Assault covers a wide variety of violent offences. A common assault is the most basic, with the least severe punishments of all assault convictions. Penalties become increasingly severe as the circumstances of the offence become more violent or have more significant consequences.
