Impaired Driving

An impaired driving charge is laid when the police believe that you have operated a vehicle while under the influence of drugs or alcohol to such a degree that it affected your ability to drive safely.

Domestic Violence

Domestic violence entails criminal charges that involve either a family member or a current/former romantic partner. Criminal charges that arise out of a domestic situation are taken more seriously by the Crown and the Court than the same criminal charges in non-domestic contexts.

Assaulting a Peace Officer

Assaulting a peace officer is classified under “Offences Against the Person and Reputation” in the Criminal Code of Canada (the “Code”). This offence has the same elements and maximum punishments as a conviction for common assault, but it specifies that the victim is a peace officer.

Drug Offence

Drug charges are those offences which arise from an interaction with an illicit drug or substance. Drug offences are listed under federal legislation called the Controlled Drugs and Substances Act (“CDSA”), not under the Canadian Criminal Code.

Youth Offences

If you have commit a crime and are between the ages of 12 and 17, the prosecution of your offence will be conducted under the Youth Criminal Justice Act (YCJA). Even though a different act governs the prosecution of youths, all of the crimes specified by the Criminal Code of Canada are applicable to young offenders.

Criminal Driving

Criminal driving encompasses multiple motor vehicle offences in the Criminal Code, and is different from charges under the Traffic Safety Act of Saskatchewan (e.g. impaired driving vs careless driving).

Assault

Assault covers a wide variety of violent offences. A common assault is the most basic, with the least severe punishments of all assault convictions. Penalties become increasingly severe as the circumstances of the offence become more violent or have more significant consequences.

Sexual Offences

Sexual assault covers a wide variety of conduct and is one of the most litigated offences in criminal law. It can include something as simple as an unwanted hug, kiss, or grope, to much more serious conduct, like intercourse.

Theft

Theft is a type of non-violent property offence that covers a variety of illegal acts, including shoplifting or taking the personal property of a friend, family member, or stranger without their consent.

  • Careful review of all documents you received from the police. We will explain what each document is, and what you can expect from and need to do for all upcoming appearances;
  • Critical review of your recollection of events, and any supporting materials you choose to bring with you. This step helps us identify possible defences and avenues for further investigation; and
  • Discussion of the court process, our fee structure, and what we can do to help.

Beyond these steps, we would be happy to tell you more about us, and answer any questions you may have. If you chose to retain us to help you, we will immediately provide an overview of what steps we plan to take next, and suggestions as to what you should do to improve your chances of a successful outcome.

We offer flexible payment options and structures designed to meet our clients’ individual needs. Our lawyers accept all major credit cards, bank drafts, money orders, email money transfers (e-transfers) and, of course, cash.

If you decide to retain us after the free initial consultation, all we need is a retainer (down payment) to get started. The rest of the fee payments for the case can be spaced out over time. We can set you up on a monthly or bi-monthly payment plan, and process payments over the telephone or by email to make it easy for you.

For the free initial consultation to be as productive as possible, you should bring (or email in advance) the following materials:

  • A written statement (preferably typed) outlining your version of events;
  • All documents that you have been given by the court or by the police;
  • Any disclosure you have received;
  • Photo ID; and
  • Any supporting documents, such as photographs, emails, texts, phone records, medical records, receipts, etc.

Ideally, you will have prepared a copy of these materials for us to keep, but if not, we can always photocopy them during the consultation.
