Careless Driving / Other Traffic Offences

Our client was charged with careless driving and failing to yield for a pedestrian after a fatal collision at a crosswalk. The victim of the offence was crossing the street while our client approached at a high rate of speed. He did not see the victim in time to stop his vehicle and struck her, propelling her 32 meters through the air. There were several witnesses to the incident. The pedestrian was fatally wounded in the collision and died a short while later at the hospital.
Upon being retained we immediately obtained and reviewed all disclosure related to the offence. We identified all weaknesses in the Crown’s case and contacted the Crown Prosecutor to discuss a potential resolution. After negotiating with the Crown, they reduced their initial sentence, and we were able to obtain a sentence that merely imposed a 60-day driving prohibition and a fine.
