Youth Extrajudicial Measures and Sanctions in Calgary

Most youth who do not have a criminal record and who have been accused of a minor criminal offence will be eligible (or at least considered) for extrajudicial measures. In more serious cases, extrajudicial sanctions may be considered, which impose a more formal set of rules on the youth involved.

Many different actors are involved in prioritizing the diversion of youth offences outside of the criminal justice system, including the arresting officers, Crown prosecutors, and various Calgary referral programs such as the Gateway Initiative and the Calgary Youth Justice Committee’s Sanctions program.

Who is Eligible for Youth Extrajudicial Measures or Sanctions?

Typically, Crown Prosecutors will have more latitude to divert matters into the Extra Judicial Sanctions Program because the main goal in dealing with young offenders is rehabilitation, rather than punishment.

It is now recognized that extrajudicial measures are often the most appropriate response to youth who commit criminal offences. As a result, Crown prosecutor’s have significant control in deciding how to divert matters out of the criminal justice system.
